E-Scooters
TERMS AND CONDITIONS FOR USE OF ELECTRIC SCOOTERS
RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT
This document affects your legal rights, including your right to sue. It contains a release of liability, an assumption of risk, and an agreement to indemnify Skyline Trails RV Park. Read it before signing or using an E-scooter.
Skyline Trails RV Park (“Park”) owns and operates the electric scooters (“E-scooters”) available here. Park uses the JoyRide mobile app (“App”) only so guests can register, add a payment card, and unlock a scooter — JoyRide does not own or maintain the E-scooters. By signing below, registering in the App, or riding an E-scooter, you (“User”) agree to these Terms. If User is under 18, a parent or legal guardian must also sign — see Section 9.
1. ELIGIBILITY AND AGE
Users must be at least 18 to sign this Agreement and rent an E-scooter on their own. Riders under 21 must wear a helmet when riding on a public street. Park may ask for photo ID and can refuse service to anyone who cannot confirm their age. IT IS RECOMMENDED THAT ALL USERS WEAR A HELMET!
2. ASSUMPTION OF RISK
Riding an E-scooter is inherently risky. You can fall, collide with something, or be seriously — even permanently — injured, even if everyone involved acts carefully.
- Losing your balance or control, or falling;
- Colliding with other riders, pedestrians, vehicles, animals, or objects;
- Uneven, gravel, wet, icy, or otherwise hazardous surfaces;
- Mechanical, brake, or battery failure;
- The E-scooter suddenly slowing, stopping, or locking at a Service Area boundary (Section 8);
- Riding at night or in bad weather; and
- The presence of other riders, pedestrians, and traffic.
By using an E-scooter, you accept these risks.
3. RELEASE OF LIABILITY
You give up the right to sue Park OR ITS OWNERS for injury, death, or property damage caused in connection with your use of an E-scooter.
E-scooters used at the Park are manufactured by OKAI (A Chinese company). A claim based on a design or manufacturing defect — as opposed to Park's own negligent maintenance — should be directed to OKAI, not Park.
Utah's age of majority is 18. Utah Code § 15-2-1. Utah's motor-assisted-scooter law separately limits use by younger children and requires adult supervision below a certain age; see Utah Code § 41-6a-1115 (confirm current subsection numbering, as this part of the Traffic Code has been renumbered).
Utah Code § 41-6a-1505 (helmet required for riders under 21 on a highway).
This release is intended to clearly and unequivocally cover claims of negligence and personal injury, as Utah law requires for it to be enforced.
4. INDEMNIFICATION
You agree to cover Park's costs and losses— including reasonable attorneys' fees — arising from your use of an E-scooter, your violation of this Agreement or the law, or injury or damage you cause to someone else or their property.
5. NO INSURANCE
Park does not carry, and is not required to carry, insurance covering your injury, medical bills, or property loss from E-scooter use.
Check your own health, auto, or renter's/homeowner's insurance before riding — do not assume any of these cover E-scooter use.
6. SAFETY RULES
You must:
- Wear a helmet if you are under 21;(recommended use for all users)
- Ride one person per E-scooter;
- Stay off sidewalks unless local rules allow it;
- Stay within the Park's posted or authorized riding area.
You must not:
- Ride while impaired by alcohol or drugs;
- Carry a passenger;
- Tamper with the motor, battery, brakes, or geofencing;
- Use an E-scooter commercially without Park's written OK.
7. REGISTRATION AND PAYMENT
Using an E-scooter requires registering in the App with a valid credit or debit card on file. By registering, you authorize Park to charge that card for:
- The rental fee posted in the App;
- A continuing fee if you do not return the E-scooter on time, until it is returned or you are charged its full replacement value, whichever happens first;
- The E-scooter's replacement value if it is lost, stolen, or destroyed and expense of repairs;
- The cost of repairing damage beyond normal wear and tear; and
- Any recovery fee if the E-scooter is found outside the Service Area (Section 8).
Confirm in the App that your session has ended, and report any billing error promptly — Park is not responsible for charges that build up because a session was not properly closed.
8. RIDING AREA (GEOFENCING)
E-scooters use GPS to stay within a set Service Area. Near its edge, an E-scooter may automatically slow, stop, or lock — without warning, even mid-ride. You are responsible for staying inside the marked area; leaving it does not excuse the charges described in Section 7.
9. MINORS
Riders under 18 need a parent or legal guardian to sign this Agreement and, where Utah law requires it, to directly supervise use. The signing parent releases their own claims and agrees to indemnify Park as described above, but Utah law does not allow a parent to waive a minor's own injury claim, and this Agreement does not attempt to do so.
10. YOUR PHYSICAL CONDITION
You confirm that you are physically able to ride safely and are not impaired by alcohol, drugs, or medication.
11. GOVERNING LAW AND DISPUTES
Utah law governs this Agreement. Any dispute goes to the state/county courts located in San Pete County, Utah.
The prevailing party in any action to enforce this Agreement may recover its reasonable attorneys' fees.
12. ACKNOWLEDGMENT AND SIGNATURE
I have read this Agreement, understand it releases Park from ordinary negligence claims, authorizes charges to my payment card as described above, and sign it voluntarily.
